This action against Immutable is part of a broader trend of regulatory scrutiny impacting various crypto firms, including Coinbase and OpenSea.

The SEC has accused Immutable of misrepresenting a 'pre-launch investment' into IMX, specifically citing an investment from Huobi Ventures that they claim did not occur.

Following the disclosure of the Wells notice, the price of the IMX token dropped significantly, falling 14% to $1.15 on November 1, 2024.

The token's trading price declined over 13% by midday on the same day, reflecting investor concerns over the regulatory scrutiny.

Immutable has criticized the SEC's approach as 'regulation by enforcement,' pointing out that the notice provided limited details about the investigation.

The Wells notice was issued shortly after Immutable's first meeting with the SEC, which is unusual given that such notices typically follow months of discussions.

Despite the SEC's scrutiny, Immutable is prepared to defend its practices and asserts that it has not engaged in any wrongdoing.

Immutable has raised approximately $300 million in funding and is well-capitalized, with significant backing from investors like Coinbase Ventures and Animoca Brands.
