The U.S. Department of Justice (DOJ) has announced plans to return nearly $12 billion worth of Bitcoin stolen from the crypto exchange Bitfinex during a 2016 hack.
The DOJ's filing aligns with a previous October 2024 document suggesting that Bitfinex, along with the defendants, considers the exchange the sole victim of the hack.
The DOJ noted that the remaining seized assets from the hack will undergo separate forfeiture proceedings, as they cannot be classified as the 'specific property' lost in the hack.
Ilya Lichtenstein and Heather Morgan, the defendants in this case, were convicted for money laundering conspiracy but were not charged with the initial hack.
Morgan, also known as 'Razzlekhan,' has continued her music career despite her impending imprisonment, releasing a music video dedicated to 'misfits' like herself.
In a court filing dated January 14, 2025, the DOJ stated that the 94,643 bitcoins recovered from hacker Ilya Lichtenstein's wallet can be returned to Bitfinex as restitution, pending court approval.
The government argues that there are no victims in this case, attributing this to Bitfinex's recovery plan, which compensated users with BFX tokens, effectively making them 'whole' after the hack.
Affected users received BFX Tokens to cover their losses, which were redeemable for shares in the parent company or for fiat currency based on valuations at the time of the hack.
The value of the stolen Bitcoin has surged dramatically since 2016, from approximately $71 million at the time of the hack to nearly $12 billion today.
Despite the compensation, some customers dispute that they have been fully compensated, raising fairness questions about user restitution.
Both Lichtenstein and Morgan pleaded guilty in August 2023 and have agreed to forfeit the stolen cryptocurrency, with Lichtenstein receiving a five-year sentence and Morgan an 18-month sentence.
