Holden Owners Sue GM Over Faulty Transmissions in Massive Class Action
January 8, 2025
Specifically, the lawsuit targets certain models of the now-defunct GM Holden brand, asserting they possess defective transmission systems.
A class-action lawsuit has been filed against General Motors Australia and New Zealand, alleging faulty transmissions in various Holden models, including the Commodore and Colorado.
Maurice Blackburn, the law firm leading the case, estimates that hundreds of thousands of Holden vehicles may be affected, potentially qualifying their owners for compensation.
Consumers can participate in the class action regardless of whether they still own the affected vehicle, have sold it, or if it has been written off, even if they have not experienced issues.
Legal papers were filed against GM on January 6, 2025, and a public call for class action sign-ups began on January 9, 2025.
A spokesperson for General Motors Australia and New Zealand declined to comment on the ongoing litigation but reaffirmed the company's commitment to customer satisfaction.
The lawsuit claims GM violated Australian Consumer Law by failing to ensure acceptable quality and engaging in misleading conduct regarding these vehicles.
The class action includes individuals who purchased specific Holden vehicles between January 1, 2011, and December 24, 2024, covering 13 different models.
Kimi Nishimura, a principal lawyer at Maurice Blackburn, stated that the alleged defects stem from a design flaw in the Torque Converter and Torque Converter Clutch.
The class action seeks compensation specifically for damages related to the identified transmission issues, although the law firm has not disclosed the number of affected vehicles or the compensation amount sought.
Reported issues from affected owners include transmission shudders, excessive vibrations, harsh gear shifts, fluid leaks, and increased maintenance needs.
The litigation is being funded by Balance Legal Capital and is being pursued in the Federal Court of Australia.
