Chairman James Comer emphasized the urgency of obtaining Bernal's testimony to avoid further delays in the inquiry, which aims to uncover whether Bernal helped conceal Biden's mental fitness from the public.

Although Bernal initially agreed to a voluntary interview, he later declined to participate after the White House Counsel's office waived executive privilege, leading to the formal subpoena.

The subpoena requires Bernal to appear for a deposition on July 16, 2025, and failure to comply could result in a contempt citation from the Justice Department.

Comer noted that Bernal, often referred to as Jill Biden's 'work husband', is considered one of the president's final trusted advisers, making his testimony crucial for the investigation.

In response to the inquiry, Biden has publicly asserted that he was fully in control during his presidency, rejecting claims about his mental state and decision-making capabilities.

Democrats have criticized the investigation as a partisan distraction from pressing issues such as economic concerns and healthcare policy, arguing it lacks substantial evidence.

In addition to Bernal, Dr. Kevin O'Connor, Biden's physician, has also been subpoenaed to testify on July 9, 2025, regarding the alleged cognitive decline cover-up.

This investigation is part of a broader Republican effort, supported by Donald Trump, to scrutinize Biden's presidency and the legitimacy of his executive actions.

The committee is exploring potential legislative changes regarding presidential fitness under Section 4 of the Twenty-Fifth Amendment, using Bernal's observations and relationship with Biden as a basis for their assessment.

The inquiry gained traction following Biden's announcement of his prostate cancer diagnosis, raising new questions about his overall health.
