Peggie’s claims included harassment related to gender identity, a protected belief, indirect discrimination, and victimisation, including an incident in a women’s changing room involving Dr Upton around Christmas 2023.

The harassment allegations encompassed sharing a female changing room with Dr Upton, who began transitioning in 2022 and started at Victoria Hospital in August 2023, and forms part of the Equality Act 2010 claims.

Peggie’s Equality Act case led to her suspension from nursing following the incident.

The tribunal also found NHS Fife should have temporarily barred Upton from using the women’s changing room after Peggie’s complaint.

Dr Upton’s team argued she was put in a difficult position and was simply performing her job, with the employer portraying her as a professional in the line of duty.

Despite the partial win, Peggie intends to continue legal action, and supporters criticized the corrections to the tribunal’s ruling, including remarks from high-profile figures.

Dr Beth Upton, a transgender doctor, left NHS Fife at the end of December 2025 after a two-year dispute related to Peggie’s case.
